Article 15 of Indian Constitution

Article 15 comes under Part 3 in the Constitution of India which deals with the fundamental rights of the citizens of India. The article 15 states that the states shall not discriminate against any citizens only on ground of race, religion, caste, sex and place of birth. Article 15 has 5 sub-division provision which are mentioned below.

Article 15 (1) & (2)

First and Second provision of article 15 prohibit the state from discriminating any citizens on ground of any religion, race, caste sex, place of birth. It provides that there shall be no restriction on any person to access and use the public places such as shops, restaurants, hotels, public entertainment places or use of wells, tanks, bathing ghats, road and places of public resort maintained wholly or partially out of State funds or dedicated to the use of the general public.

Article 15 (3)

Onward of third provision of Article 15, constitution has started protective discrimination. It makes the states to create specials provisions for protecting the interest of women and children.

Article 15 (4)

It make special arrangements for promoting the interests and welfare of socially and educationally backwards such as SC/ST.

Article 15 (5)

This article 15 (5) moves a step ahead and empower the country to make reservation with regard to admissions into educational institutions both privately run and those that are aided or not aided by government. Only minority educational institutional (i.e. Madarsas) have been left out of this provision.

Hence Article 15 (3) and 15 (4) are main fundamental bricks of reservation in the country.
