Parliament is a law-making body. Parliament consists of the President and the two Houses known respectively as the Council of States (Rajya Sabha) and the House of the People (Lok Sabha). [In Polity, we call it as Bicameral Legislature – 2 House (Bicameral) & Legislative mean – Law making].

Other Name of Lok Sabha : Lower House (25 Years Age), Popular House, Temporary House (not able to show confidence). – Tenure of Lok Sabha increases by 1 years – War/ External Aggression/ Internal Disturbance.

Qualification for Lok Sabha

  • Age : 25
  • No Office of Profit
  • Unsound Mind
  • No Bankrupt

Total Member/ Max Members – 552 [530 (States) + 20 (UTs) + 2 (Anglo Indians)], where Anglo means English or British (In Parent, any one – father or mother should be Indian or British). At Present – 545 [530 + 13 + 2].

Prime Minister is the head of Lok Sabha. Chairman is Speaker.

Session of Parliament – BMW (Budget, Monsoon, Winter)

Time Period of Budget : Feb – May

Monsoon : Jul – Aug

Winter : Nov – Dec

Council of Minister : Prime Minister can choose the Council of Ministers 15% of Lok Sabha members (around 81).

Terms used in Lok Sabha

a). Adjournment : recess –  by speaker

b). Prorogation : Ending of session – by President with Council of Ministers

c) Dissolution : House Dissolve – by President (No confident Motion)

Other names of Rajya Sabha : Upper House (30 Years), Permanent House, Council of States (elected by State Assembly)

Total Member/ Max Members – 245 . At present 250 [238 indirectly elected by legislative assembly + 12 nominated by President]

Election is of two types –

Direct Election : In which we vote, Lok Sabha, Vidhan Sabha, Panchayat, Municipality Elections.

Others are Indirect Elections.

Qualification for Rajya Sabha

  • Minimum Age – 30 Years, Vice President Age (35 Years)
  • Citizen of India
  • Not hold – Office of Profit. (Can’t take salary of two Government Job)
  • Fields – Literature, Art (Sports), Science, Social Services
  • No bankrupt

Rajya Sabha Power

  • All India Services (Bill come first in Rajya Sabha – IAS, IPS, Judicial Bill).
  • Join Sitting (It can’t possible without Rajya Sabha – Bill -> L.S -> R.S -> President). [If bill is going between L.S and R.S more than 6, then deadlock occurs. After this only, President calls for Summon of both Lok Sabha as well as Rajya Sabha.]

President : First Highest Constitution Posts. Executive Actions / Implemented by Presidents. If any bill has not sign of President, that can’t be passed. Minimum Age is 35 Years and tenure is 5 years.Voted by elected members of Lok Sabha and Rajya Sabha, State Legislative Assemblies and 2 UTs (Delhi and Puducherry)- 70th Amendment 1992. No role of Vidhan Prishad (i.e. state legislative of council.) Oath by Chief Justice of India – Senior-most judge of India. If CJI is not available, then senior judge after CJI will provide the oath to President. If President want to resign, he/she give to vice-president.

Impeachment (Violation/ misbehave of Constitution) : 1/4th members of either house  , give written to president, given 14 days times to president.

Mean Council of States, where the representatives are indirectly elected by the elected representative of the Assembles of States and Union Territories. House of the People, where people who are eligible to vote can elect their representative by way of direct elections.

Introduction of Money Bill After the bill is approved in the Lok Sabha, it is sent to the Rajya Sabha for consideration. Only in Lok Sabha
