Speaker of Lok Sabha is come under Article 93.  Speaker is elected by Lok Sabha amongst its members, as soon as after the first meeting. The date of election is fixed by the President. Usually, he/she remains in his office during the life of the Lok Sabha.

Lok Sabha Speaker Removal

He/She vacates office earlier in any of the following cases –

  • If he ceases to be member of Lok Sabha;
  • If he resigns by writing to the Deputy Speaker; and
  • If he is removed by a resolution passed by a mojority of all the members of the Lok Sabha. Such a resolution can be moved only after giving 14 days advance notice.

Under Resolution of removal, the Speaker cannot preside at the sitting of the House (he may be present). (Article 96)

Whenever the Lok Sabha is dissolved, the Speaker does not vacate his office and continues till the newly elected Lok Sabha meets.

Role, Powers and Functions of Speaker

  • Speaker is the principle spokesman of the House, and his decision in all Parliamentary matters is final.
  • He/She maintains order and decorum in the House for conducting its business.
  • He/She adjourns the House to suspend the meeting in the absence of quorum (presence of only 1/10th of the total strength of the house).
  • He/She does not vote in the first instance, but he can exercise a casting vote in the case of a tie (dead lock).
  • He/She presides over a joint sitting of two Houses of the Parliament.
  • He/She can allow a ‘secret’ sitting of the House.
  • He/She certifies a Bill as Money Bill and his decision cannot be challenged.
  • He/She presides over a joint-sitting of the two Houses. He appoints the Chairman of all the Parliamentary Committees of Lok Sabha.

Deputy Speaker

  • While the office of the Speaker is vacant due to any reason, the Deputy Speaker presides. (Article 95)

Anthasayanam Ayyangar was the First Deputy Speaker of Lok Sabha. At present M Thambidurai is Deputy Speaker of Lok Sabha (12 Aug 2014 till date).

Speaker of Lok Sabha Eligibility Criteria

Eligibility criteria to become the Speaker of the Lok Sabha is:

  1. He or she must be a citizen of India;
  2. He or she must not be less than 25 years of age; and
  3. He or she should not hold any office of profit under the Government of India, or a state government.

Pro tem Speaker

After a general election and the formation of a new government, a list of senior Lok Sabha members prepared by the Legislative Section is submitted to the Minister of Parliamentary Affairs, who selects a pro tem speaker. The appointment has to be approved by the president.

The first meeting after the election when the speaker and the deputy speaker are selected by members of the Parliament is held under the pro tem Speaker.

Who carries out notification for the election of the Lok Sabha?

Election Commission is the constitutional authority to issue notification for the election of the LokSabha.
